Bus Ride Turns Deadly

Timothy D. Barbour tried to defuse a scuffle that broke out on a TARC bus Saturday night.

But in the process, gunfire erupted, killing the 26-year-old Barbour and wounding another man who also tried to help, according to Lieutenant Barry Wilkerson, head of the Louisville Metro Police homicide unit.

Police arrested 22-year-old Apollo R. Avery, charging him with murder, first-degree assault and several counts of wanton endangerment.

Homicide detectives are continuing to investigate. Police are reviewing video from a surveillance camera on the bus.

The incident happened about 10:40 p.m. at 10th Street and Broadway, in front of the Transit Authority of River City's Union Station headquarters.

Police said an altercation apparently broke out on the bus between some men and women. At some point, Barbour and the injured man got involved, apparently to try to break up the argument.

The driver pulled over to let people off the bus at the intersection, and shots were fired.

Barbour was taken to University Hospital, where he died at 11:19 p.m., according to Jo Ann Farmer, Jefferson County chief deputy coroner.

After the shooting, the driver moved the bus, which had other passengers on board, to Ninth and Kentucky streets, police said.

The injured man, who had remained on board, was taken to the hospital from there with injuries that did not appear to be life threatening, according to Officer Phil Russell, a police spokesman.

Barry Barker, TARC's executive director, said the agency is cooperating with the investigation.

He said standard operating procedure is to move a bus away from a bad situation if possible out of concern for the safety of the passengers.

He said officials plan to look at policies and procedures to see if anything needs to be changed.

Police are asking anyone with information about the shooting to call the anonymous tip line at 574-LMPD.
