Court Strikes Down Restitution For Extradition

The Kentucky Court of Appeals has struck down orders requiring three people to pay restitution to the state to cover the costs of their extradition back to Kentucky.

The three-judge panel on Friday overturned judicial orders in a trio of cases out of Louisville. In those cases, the defendants failed to appear for court hearings and fled to other states.

After being caught, judges ordered all three to pay restitution to the Kentucky State Treasury to cover the cost of extraditing them.
Judge Donna Dixon, writing for the court, found that Kentucky wasn't a victim who suffered a loss stemming from a criminal act and, therefore, wasn't entitled to restitution.

Dixon also found that the extradition law doesn't require a fugitive to repay the state.
