According to an arrest citation, 27 year-old James D. Capps had sexual intercourse with a 15-year-old juvenile multiple times in his bedroom and once in a kitchen. Capps was aware of the victim\u2019s age because he is related by marriage to the victim.<\/p>\n
Capps made sexual advances toward the victim and requested obscene photos in exchange for $70, as well as, Capps forced the victim to pleasure him, according to the citation.<\/p>\n
The victim had text messages on her phone in which she sent Capps obscene pictures of herself at his request and Capps sent text messages to the victim begging to meet up for sexual intercourse on multiple occasions.<\/p>\n
Capps was charged with third-degree rape; first offense possession of matter of sexual performance by a minor; procuring or promoting use of a minor by electronic means and use of a minor in a sexual performance.<\/p>\n
Capps is being held in the Hardin County Detention Center under a $50,000 cash bond. He is scheduled to appear in court on April 14.
