The judge would have a hearing, giving the prosecutor and victims of the case a chance to weigh in. The decision to vacate a judgment will be up to the judge in the case but, to be eligible, the law says felons must wait five years after completing their sentence. They must not have any pending charges or arrests. And vacating judgments can be done only once in a person&#8217;s lifetime.<\/p>\n<p>Bevin called it an &#8220;incredibly momentous piece of legislation&#8221; and said he was honored to sign it. The bill has languished in the state legislature for years after repeated failures to get through the Republican-controlled state Senate.<\/p>\n<p>Of the more than 350 Class D felonies in Kentucky, the new law applies to only 61 of them. But those 61 cover nearly 71 percent of the people convicted of Class D felonies from 2011 to 2015, according to records provided by the Senate Judiciary Committee.
