\nA federal grand jury in Bowling Green has indicted a Logan County man on several charges, including drug trafficking, as well as firearm possession in connection with drug trafficking and possession of a firearm as a convicted felon.<\/p>\n

The indictment alleges 39 year-old Joshua O. Duncan possessed with intent to distribute 500 grams or more of methamphetamine mixture and 400 grams or more of fentanyl mixture on February 15 in Warren County, according to the U.S. Attorney\u2019s Office in a Friday news release.<\/p>\n
Alongside the drug-related charges, Duncan is accused of possessing multiple firearms, including a Smith and Wesson .38 caliber revolver, a Springfield Armory .45 caliber semiautomatic pistol, a Ruger .380 caliber semiautomatic pistol, and a Smith and Wesson .40 caliber semiautomatic pistol. His prior felony convictions, including first-degree trafficking in a controlled substance, legally prohibited him from owning firearms.<\/p>\n
Duncan appeared in court for the first time Thursday before a U.S. Magistrate Judge in the United States District Court for the Western District of Kentucky.<\/p>\n
If convicted, Duncan faces a minimum sentence of 15 years in prison, up to a maximum sentence of life imprisonment. A federal district court judge will determine any sentence after considering the sentencing guidelines and other statutory factors. There is no parole in the federal system.<\/p>\n
The investigation into this case is being led by the ATF Bowling Green Field Office and the Bowling Green\/Warren County Appalachia High Intensity Drug Trafficking Area (AHIDTA) Drug Task Force.<\/p>\n
Assistant U.S. Attorney Mark J. Yurchisin II, from the U.S. Attorney\u2019s Bowling Green Branch Office, is prosecuting the case.<\/p>\n
An indictment is merely an accusation, and all defendants, are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
