Marc Hibel appeared in court Thursday morning for a change of plea hearing. Hibel was pleading not guilty to wanton endangerment and burglary charges, but during the court hearing, Hibel agreed to plead guilty to lesser charges.<\/p>\n
Instead of two counts of burglary, Hibel is now pleading guilty to two counts of criminal trespassing, one count of wanton endangerment and one count of possession of a controlled substance. This is an Alford plea, meaning Hibel still maintains his innocence but agrees to plead guilty because he is acknowledging that if this went to trial he would likely be convicted.<\/p>\n
Hibel and his attorney\u2019s position is that they admit Hibel had all of these hazardous materials in his home on Applegate Lane, but they disagree that they ever posed any danger. Regardless, this plea deal carries a recommended sentence of three years probated.<\/p>\n
That means Hibel won\u2019t spend any time in jail, but will be on probation and will have to keep pursuing mental health treatment. He will be officially sentenced on November 4.
