Thomas Embry was indicted on charges of murder-domestic violence and criminal abuse first-degree on a child 12 or under back in December of 2021. Over three years later in February of 2025, a judge has ordered that indictment be dismissed without prejudice.<\/p>\n
According to court documents, officials tried to let the child\u2019s mother know about the motion to dismiss but were unable to reach her.<\/p>\n
The Commonwealth filed a motion to dismiss the case on January 30, citing \u201cissues that have arisen that deserve further consideration and, in some instances, further investigation.\u201d Since the dismissal request and order were without prejudice, that means the charges can be refiled in the future if more evidence is found.<\/p>\n
Charges against Embry initially arose following the death of his infant son, Travis Embry, in May of 2021. An autopsy report from the time showed the child had died due to a significant brain hemorrhage later reported to be from an inflicted closed head injury, also known as shaken baby syndrome.<\/p>\n
Embry was released from custody on February 10.
