The request was on their October agenda but was held over due to the highly scrutinized zoning request in Garrett. The property owned by Powers is located a about mile from the other proposed Light Industrial request causing magistrates to research further options before considering the second request.

Powers was in attendance at Monday’s meeting and answered questions related to his plans for the request. He said that he is intending to build a 250,000 square foot warehouse building to allow expansion of his business, Power Paper Company. The property is located between Kentucky 448 and Kentucky 313 with access from both roads. He plans to use the entrance on Kentucky 313 for trucks and employees and other traffic to enter the site from Kentucky 448. Power said the project will be contained within parcels that he owns and doesn’t intend to sell that adjoins his other property. He said the project is an investment in his business and the community as the facility would allow needed expansion that he cannot achieve at his Brandenburg location which is land locked.

He said that a barn would also likely be built to support growth in the family’s agricultural business. He and others countered opposition to the project who had compared his rezoning request against the failed Hobbs rezoning last month. Power’s project already has a submitted development plan and the project meets all of the requirements for a light industrial including being located in a section of Kentucky 313 that has be identified as the next industrial area in the county. Power said that he understood that the Kentucky Transportation Cabinet is planning to extend Kentucky highway 144 to Kentucky 313 which would enhance the industrial potential in that area of the county. The Hobbs rezoning request was made for a potential sale of the property with no site or development plans or any details of a potential owner could be.

After Power addressed his plans and intent for the request the conversation briefly centered upon what could happen to the property years in the future and how would the property could be used if the requested change was approved. County Attorney Sydney Durham caution county leaders to view the zoning requests based upon a case by case basis instead of a broad approach to cover all future scenarios which would have to be evaluated by the same proceeds if the use of the property changed. After the lengthy discussion and comments, fiscal court voted to approve the zoning request by a unanimous vote.

In other business, the court voted to continue the verbal moratorium on any future data centers at the request of the county attorney. Durham asked for the extension due to the drafted document had not been publicly published in the correct amount of time for the court to enact the measure. She asked that the formal moratorium be presented at the December meeting. The language of the document would not allow any data centers a permit to built for at least the next 12 months to allow Fiscal Court time to properly draft an amendment to Planning and Zoning ordinance for such facilities.

The court approved the appointment of Brandon Pesis to the Battletown Fire Department Board and they opened bids for EMS ambulance bids and remounts. They voted to approve the lowest bid that meets the bid specifications. It will take at least 16 to 36 months to take delivery of the remount and new ambulance according to suppliers.

The special called meeting was to conduct the county’s regular monthly business on a special date due to the Veterans Day holiday.
