\nState Farm Insurance has filed a motion to intervene in the wrongful death lawsuit against convicted murderer Brooks Houck.<\/p>\n

Houck was convicted of murdering Crystal Rogers in July and is now serving a life sentence. He is being sued by Rogers\u2019 mother Sherry Ballard.<\/p>\n
Ballard filed the lawsuit with Rogers\u2019 children in December 2023 following her appointment as the administrator of Rogers\u2019 estate after Houck had been charged with murder three months prior.<\/p>\n
That motion stated Houck \u201cintentionally and wrongly\u201d caused Rogers\u2019 death. Ballard claims she is entitled to recover damages from Houck including:<\/p>\n
Reasonable and necessary funeral, monument and administrative expenses
\nPhysical pain and mental suffering experienced by the decedent before her death
\nLost earnings incurred by the decedent
\nLoss of decedent\u2019s enjoyment of life
\nLoss of decedent\u2019s power and ability to earn money<\/p>\n
Houck uses State Farm for rental insurance and the company stated in their motion filed on Thursday that their policy does not apply to any damages the lawsuit could award.<\/p>\n
Their attorneys responded writing, \u201cState Farm\u2019s policies do not provide coverage for Plaintiffs\u2019 claims against Defendant Brooks Houck. State Farm seeks to intervene for the purpose of participating in discovery and filing a dispositive motion on State Farm\u2019s coverage obligation,\u201d lawyers for State Farm wrote in their motion.\u201d<\/p>\n
The motion is set to go before a judge on January 7 in Nelson Circuit Court.
