The lawsuit alleges an older student on the school bus, which transported both middle school students and younger students with special needs, sexually assaulted a 7-year-old student at least three times the week of February 16, 2026 while they were in the vehicle. The younger student is both autistic and nonverbal.<\/p>\n
Both a bus monitor and a driver were present on at least two of the mornings that week and did nothing to stop or report the abuse, according to the lawsuit.<\/p>\n
District employees are accused of not reviewing the school bus footage until four days later, and it was only after a different parent reported her child was hit by the same older student, the lawsuit alleges. <\/p>\n
An administrative review with the older student happened a day later, where they admitted to the sexual abuse, the lawsuit alleges.<\/p>\n
Three others, including the superintendent, were responsible, upon information and belief, for reporting the suspected child sex abuse occurring within the school system to law enforcement and the Kentucky Cabinet for Health and Family Services as required by state law, according to the lawsuit.<\/p>\n
The lawsuit accused both the bus monitor and driver of negligence, and the three other people are accused of negligence per se\/failure to report.<\/p>\n
The family is requesting a trial by jury, punitive damages and judgement on physical, emotional and medical expenses.
