
Authorities say an Elizabethtown couple drove to Jefferson County Monday morning with plans to engage in sex with a minor with whom they had been communicating.
Instead of finding a minor, they found an undercover agent who portrayed a minor in online conversations.
According to the Kentucky Office of the Attorney General, 43 year-old Robert Dean Mitchell and 30 year-old Stephanie Smith were arrested in Louisville. According to the news release, a 3-year-old and 6-year-old were with the couple when the arrest was made.
Each was charged with one count of prohibited use of an electronic communication system for the purpose of procuring a minor for a sex offense, a Class D felony punishable by one to five years in prison, if convicted.
Mitchell and Smith also are charged with one count of possession of a controlled substance — methamphetamine, a Class D felony. Mitchell was charged with possession of marijuana, a misdemeanor, and Smith with possession of drug paraphernalia, a misdemeanor.
The undercover operation was part of Attorney General Andy Beshear’s Cyber Crimes Unit.
The Secret Service assisted in the arrests.
Mitchell and Smith are scheduled to appear in Jefferson District Court. They are being held in the Jefferson County Detention Center.
