
James Small was sentenced to five years probation for shooting his friend and roommate, Charl Hertzog, in October 2023.
Small was convicted of reckless homicide. He was originally charged with manslaughter.
After the shooting, which happened in the 6400 block of Duroc Avenue, Small eventually turned himself in and told police it was an accident. He added that he had been smoking weed and drinking alcohol when it happened.
Small’s been on home incarceration since his arrest. His five-year probation period will prohibit him from using any kind of drugs or alcohol, lest he end up back behind bars.
The family of Charl Hertzog supported the decision to grant probation.
Small can now ditch his ankle monitor and begin probation. He must retain full-time work or status as a full-time student.
