
The lawsuit filed against River City Firearms after the Old National Bank shooting is moving forward after a judge denied the business’ motion for dismissal.
Families of those killed in the shooting are suing River City Firearms for selling the gun and accessories used by the shooter. The lawsuit focuses on the grip and “red dot sight” and the fact the sale was made, even though the shooter gave warning signs like being unfamiliar with the gun and not making eye contact.
The business argues Kentucky law doesn’t allow for these types of arguments, and federal law prohibits this type of legal claim also.
But Judge Mitch Perry disagreed, denying the motion to dismiss. Now, the case will move forward with discovery.
