Two men who were on duty during the hours leading up to the January 11 death of 16 year-old Gynnya McMillen at Lincoln Village Juvenile Detention Center in Elizabethtown were indicted Thursday by a Hardin County grand jury.
Reginald Wyndham and Victor Holt each were indicted on one count of second-degree official misconduct, a Class B misdemeanor punishable by up to 90 days in jail and a fine of up to $250.
Wyndham’s employment was terminated at Lincoln Village early in the investigation into McMillen’s death.
John Tilley, secretary of the state Justice Cabinet said Wednesday during a news conference two Lincoln Village employees were still on leave, one had resigned and three others face suspension.
Commonwealth’s Attorney Shane Young said the charges stem from “missed bed checks” on McMillen. He said he scheduled the cases against them two weeks ago to be presented to a grand jury.
Young said there was nothing the two did “that led to her death or that her death could be prevented” by them. He said the indictment reflects their role as a public employee and their responsibility to do their job.
McMillen died in her sleep from a rare heart condition known as sudden cardiac arrhythmia according to her autopsy report. She was sent to Lincoln Village January 10 after a physical altercation with her mother and her mother’s male friend.
Hardin County Attorney Jenny Oldham said Wyndham and Holt should make district court appearances in the next few weeks.
