The second suspect indicted for two murders at the Waffle House restaurant in Radcliff in July was arrested after more than a month on the run.
Darien Khalil McGary, 25, was arrested at 9 p.m. Thursday (09/21) with the assistance of the U.S. marshals, according to Radcliff Police Chief Jeff Cross.
McGary was indicted, along with 33 year-old Rodshad Akeem Bowser-Highsmith for the deaths of 30 year-old Carlos Devonne Bello and 18 year-old Shane Anthony Estrada after a 4 a.m. July 22 shooting at a Waffle House on South Dixie Boulevard in Radcliff.
McGary and Bowser-Highsmith were seen and heard on a surveillance video talking about taking a firearm from one of the victims before the shooting, according to the citation. It did not specify which victim.
At 3:49 a.m., Bowser-Highsmith assisted McGary in the plan of taking the firearm and, in the process, Bello and Estrada were shot and killed, according to the arrest citation.
The document also claims Bowser-Highsmith fired multiple rounds at a vehicle and at patrons leaving the Waffle House.
Bowser-Highsmith “freely admitted to his involvement,” according to the citation.
Bowser-Highsmith was arrested July 24 and has entered a plea of not guilty. He was also charged with complicity to commit first-degree robbery and attempted murder. He is being held on a $500,000 cash bond in the Hardin County Detention Center.
Some witnesses have said McGary resided before the shooting in a home on South Woodland Drive where 22 year-old Kevin Maurice Estes was shot dead on August 17 in the home’s yard. Cross has said he was shot multiple times.
The suspects in that case have not been identified and have avoided capture. Cross said Friday he had no new details to release in the Estes case.
Cross has not commented on whether or not the two shootings are connected and said the investigation into both is ongoing.
McGary was directly indicted while on the run for two counts of complicity to commit murder and complicity to commit first-degree robbery.
Murder is a capital offense punishable by life or 20 to 50 years in prison on each count and first-degree robbery is a Class B felony punishable by 10 to 20 years in prison.
McGary is being held at the Hardin County Detention Center in lieu of a $500,000 cash bond.
