
The former Letcher County sheriff accused of killing a district judge in his chambers last September has moved to have his indictment dismissed.
Shawn “Mickey” Stines is charged with murdering Letcher County District Judge Kevin Mullins.
In new court documents filed Wednesday, Stines’ attorneys accuse the prosecution of having an undocumented meeting with the grand jury prior to the former sheriff’s indictment.
His attorneys also allege the grand jury had asked for records which the Commonwealth did not provide. They claim the two incidents biased the jury.
Stines’ attorneys are requesting a hearing to present evidence to prove the bias and are asking the judge to dismiss the indictment with prejudice, meaning Stines couldn’t be tried again.
Earlier this year, Stines’ attorneys filed a notice of their intent to use an insanity defense.
Prior to the shooting, Stines and Mullins got into an argument and went to Mullins’ chambers to continue their discussion.
During Stines’ probable cause hearing, surveillance video capturing the entire shooting was played in court. The video showed Stines firing his weapon several times at Mullins.
After the first series of shots, video showed Mullins attempting to take cover behind his desk. Stines is then seen walking around and firing more shots. Just as Stines is about to exit the room, he stops and fires at Mullins again.
Police have not offered any details about a possible motive.
