A Louisville murder suspect who has spent two years in jail awaiting trial was ordered released from custody after a tense hearing between prosecutors and the judge.
Police arrested David Morales in June of 2023 in connection to the murders of 32-year-old Haris Boskailo and 21-year-old Alden Fernandez outside of Hoops Grill & Sports Bar on Strawberry Lane two months prior. He was then charged with two counts of complicity to murder, complicity to tampering with physical evidence and complicity to receiving stolen property under $10,000.
Morales was set to go to trial on June 9, 2025, but his attorneys argued the case should be dismissed because the Commonwealth just turned over a bunch of evidence the day before, including a recorded interview with co-defendant Isaac Castellanos.
Judge Julie Kaelin asked why the delay in turning over the evidence.
Eventually, the team of attorneys said they didn’t think they had to turn over the interview, since they were planning to use Castellanos as a witness. They blamed trial prep and safety concerns.
The judge took a break and returned to the courtroom a few minutes later to continue the hearing. She accused the Commonwealth of “playing games,” then dismissed the charges and ordered Morales be released from custody.
A hearing will be held to determine if the charges will be dismissed with or without prejudice.
