A man has been arrested for plotting to kill a Kenton County commonwealth attorney and judge, according to court records.
The court documents say 48 year-old Brian Keith Tucker is charged with retaliating against a participant in a legal process after police received a tip from Tucker’s friend.
Sometime between October 1 and November 26, the friend reported to a detective that Tucker had been threatening to kill Commonwealth’s Attorney Rob Sanders and a female judge, Kathy Lape, according to court documents.
The friend said Tucker wanted to kill the two because he was unhappy about not being paid from a civil lawsuit related to an arson charge, which he was found not guilty of.
Sanders prosecuted the case and Judge Lape presided over the trial.
Tucker and Sanders were members of the gym they frequented and expressed plans of how he would go about the killing at that location.
According to the complaint, Tucker planned to sneak up behind Sanders at the gym and “slit his throat,” or hide in the woods and “snipe” Sanders with a rifle.
Court documents show that the friend of Tucker said he had also become a target of Tucker’s deadly threats and attributed it to his consumption of large amounts of cocaine.
Kenton County Sgt. Ryan Roessier continued the investigation and contacted Tucker’s girlfriend.
This girlfriend, per documents, also said Tucker has been acting erratically and hadn’t been home in a few days.
Through her, Sgt. Roessier was able to talk with Tucker’s brother, who told him Tucker was suffering from a “mental break” and was going through “violent mood swings”.
Tucker’s brother, according to court records, advised police that Tucker is very violent, hates police and urged extreme caution in any encounters with him.
Tucker is now being held in Boone County Jail on a $500,000 bond.
