A Louisville man made his first court appearance Monday morning, nearly three weeks after police said he chased and hit a van with three young girls inside during a “road rage” incident.
Graham Bain, 41, pleaded not guilty to four counts of wanton endangerment in arraignment court for the February 26 incident that ended with him being shot. His arraignment was rescheduled several times after his arrest because he was hospitalized.
According to his arrest citation, Bain allegedly “brake-checked” a van around 9:30 a.m. that Wednesday after turning left in front of it near Taylor Boulevard and Beecher Street.
Police said the van’s driver quickly switched to the right lane and reentered the left lane after passing Bain, who then passed the van in the right lane and attempted to cut it off at the traffic light at Taylor Boulevard and Interstate 264.
He continued to chase the van as it picked up speed, attempting to cut it off several more times. During the chase, police said Bain hit the van, which had three young girls inside, with his vehicle multiple times.
That is when the driver of the van fired one shot toward Bain’s vehicle, telling police he was “in fear for his passengers’ lives.” The van then quickly turned onto a side street, making its way back onto Taylor Boulevard North with Bain still in pursuit.
According to his arrest report, the van turned onto Carlisle, coming to a stop between Henry Avenue and Taylor Boulevard because it was damaged and had several flat tires. Police said Bain’s vehicle was then seen hitting the van on the driver’s side “at a high rate of speed,” nearly causing Bain’s vehicle to flip on its side.
The driver of the van then pointed his gun at Bain and ordered him to stop. He told police he fired several shots when it appeared Bain was trying to put his car back into gear. Police said Bain was hit in the “lower right abdomen,” but continued to put his vehicle in reverse and hit the van again several times. At one point, police said, he almost hit the driver of the van.
The van was equipped with an in-car camera that recorded the incident, according to police.
Bain was arrested at the scene. In the recording of the incident, police said he showed “extreme indifference to the value of human life and engaged in conduct that created a substantial danger of death or serious physical injury” to the driver of the van and its passengers.
In court Monday, Bain’s bond was set at $100,000 and he was ordered to have no contact with the victim. He is also prohibited from operating a vehicle, and from using or possessing a firearm or other weapons, according to court records.
Bain is being held at Metro Corrections in downtown Louisville and is scheduled to make another appearance in court next week.
