A Warren County grand jury has indicted a man after he was involved in a crash that claimed the life of a toddler on January 6.
Jorge L. Iturbide, 32, was arrested and charged in connection to the crash, which happened near Greenwood High School on Scottsville Road. When officers arrived at the scene, they noticed one vehicle was struck from behind and a second one was resting against a utility pole.
The indictment, issued on March 13, lists a series of charges against Iturbide, including murder, two counts of first-degree assault, first-degree criminal mischief, operating a motor vehicle while under the influence of intoxicants, failure to maintain required insurance as an owner, and driving without an operator’s license.
According to the indictment, the incident marks Iturbide’s second offense within 10 years of driving while intoxicated. The charge is “aggravated,” which means the offense carries a more serious consequence if convicted.
A GoFundMe campaign started for the family identified the deceased child as 2-year-old Jhavarion Peay. The child’s sister, 5-year-old J’cyonna Peay, and their father, Braxton Peay, were also involved in the crash.
Iturbide entered a plea of not guilty to the charges during his court appearance on Tuesday. He has been appointed a public defender for his legal representation. A pretrial conference is scheduled for May 13 at 9 a.m. with Judge Christopher T. Cohron presiding.
Iturbide remains in custody with a bond set at $1 million.
